Brampton’s rules in plain English

Brampton calls basement apartments and garden suites Additional Residential Units (ARUs). Since May 2023, the city allows up to 3 units on a property, including the main house: the main house plus one attached second unit and one garden suite, or the main house plus a second and a third attached unit. Every second unit, third unit and garden suite must be registered with the City of Brampton to be legal (City of Brampton).

Registration goes through a building permit: drawings, a legal survey, and inspections for things like fire separation, smoke and carbon monoxide alarms, exits, ceiling height and electrical safety. Since April 1, 2024, properties on land regulated by the Credit Valley or Toronto and Region conservation authorities also need conservation authority approval.

How to check if a Brampton basement is legal

  1. Search the address on the city’s map of registered units. Brampton publishes an interactive map of every registered two-unit and three-unit dwelling and garden suite. If the address is not on it, treat the unit as not registered.
  2. Read the listing wording carefully. “Separate entrance”, “in-law suite” or “income potential” is not the same as “registered second unit”.
  3. Ask the seller for the permit and registration documents and have your lawyer confirm them before your conditions expire.
  4. Get a home inspection that looks at the unit specifically: fire separation, exits, alarms, ceiling height and any unpermitted work.
  5. Tell your lender. Lenders treat registered rental income differently from an unregistered suite, which changes how much you can borrow.

If you plan to add a unit, get a designer who knows Brampton’s ARU process, budget for the permit drawings and inspections, and check whether the property is on conservation-authority land before you buy. The federal Canada Secondary Suite Loan Program and the Region of Peel renovation program are listed by the city as funding sources; check their current terms.
